Cop on Tape: “You Must Be Doing Something Wrong if You Need to Invoke Your Rights”

It has been upheld time and time and time and TIME again that the First Amendment protects one’s right to film police officers in public. Period.

That is it. End of story.

It is also not illegal to film locations from public property, even those that have been designated as “secure.” A sign is not a law and does not negate the Constitution. It just isn’t and it just doesn’t, despite an apparent effort to make it seem that way.

Now listen to what this cop says to these guys who recently decided to film prisoners being transported in and out of the Duval County, Florida courthouse’s sally port without identifying themselves:

What if at every Thanksgiving liberty is weakened and the government is strengthened?




What if another Thanksgiving Day is upon us and because of the government we have less to be thankful for than we did at the last one? What if at every Thanksgiving liberty is weakened and the government is strengthened? What if Thanksgiving's warm and breezy seduction of gratitude is just the government's way of inducing us to think we should be grateful for it?

What if we don't owe the government any thanks for anything? What if the government owes us back all the freedom and property it has stolen from us? What if the government has produced nothing and owns nothing, save what it has coerced us to give it? What if the courts have ruled that the government can lie and cheat with impunity in order to acquire our property or assault our freedoms?

In his address to the nation, September 10 2013, President Obama backed off on attacking Syria but still reserves the right to do so if diplomacy fails.

…I'm also the President of the world's oldest constitutional democracy. So even though I possess the authority to order military strikes, I believed it was right, in the absence of a direct or imminent threat to our security, to take this debate to Congress.
Like President Bush before him, President Obama makes it easy to blame him. Maybe it just takes too much effort to recall that nothing happens in a vacuum including presidents whose actions don’t reflect the will of the people. Events in nature and the world of humans are always informed by what came before. What came before in America are event after event resulting in the consolidation of power in the hands of a few.

Americans will soon be locked into an unaccountable police state unless US Representatives and Senators find the courage to ask questions and to sanction the executive branch officials who break the law, violate the Constitution, withhold information from Congress, and give false information about their crimes against law, the Constitution, the American people and those in Afghanistan, Pakistan, Yemen, Iraq, Libya, Syria, Somalia, Guantanamo, and elsewhere. Congress needs to use the impeachment power that the Constitution provides and cease being subservient to the lawless executive branch. The US faces no threat that justifies the lawlessness and abuse of police powers that characterize the executive branch in the 21st century.

Impeachment is the most important power of Congress. Impeachment is what protects the citizens, the Constitution, and the other branches of government from abuse by the executive branch. If the power to remove abusive executive branch officials is not used, the power ceases to exist. An unused power is like a dead letter law. Its authority disappears. By acquiescing to executive branch lawlessness, Congress has allowed the executive branch to place itself above law and to escape accountability for its violations of law and the Constitution.

National Intelligence Director James R. Clapper blatantly lied to Congress and remains in office. Keith B. Alexander, Director of the National Security Agency, has also misled Congress, and he remains in office. Attorney General Holder avoids telling Congress the truth on just about every subject, and he also remains in office. The same can be said for President Obama, one of the great deceivers of our time, who is so adverse to truth that truth seldom finds its way out of his mouth.

Declaration 2.0: A Fresh Start for America

Declaration 2.0, July 4, 2013, is an idea whose time has come. It addresses many of today’s grievances held by the American people and, as such, echoes the original July 4, 1776 Declaration of Independence from the British monarchy.

Declaration 2.0 only changes original phrasing when necessary to make specific grievances relevant to today and uses the original format and capitalization style. It is a declaration to free Americans from the statutory-law U.S. Government that has “become destructive,” no longer “deriving their just powers from the consent of the governed.”

The phrase “free inhabitant(s)” refers to how early Americans were identified in the Articles of Confederation and Perpetual Union, the country’s first constitution, ratified 1781 by 13 states.

The bold assertions made in Declaration 2.0 are based on deep research for the book, Beyond the National Myth: waking up in the land of the free. The hope is that someone or an organization will take it upon themselves to begin the process of gathering millions of signatures. There is no fixing what we already have. America and her people need a fresh start.

Supreme Court: We Must ‘Expressly Invoke’ Our Rights to Have Them Upheld

Earlier this month, the same Supreme Court who found thatAmericans can be strip searched during an arrest for any offense also found that a person’s silence can, in fact, be used against him if he does not officially announce that he is invoking his Fifth Amendment right to remain silent.

The Atlantic Wire reported:

Basically, if you’re ever in any trouble with police (no, we don’t condone breaking laws) and want to keep your mouth shut, you will need to announce that you’re invoking your Fifth Amendment right instead of, you know, just keeping your mouth shut. ‘Petitioner’s Fifth Amendment claim fails because he did not expressly invoke the privilege against self-incrimination in response to the officer’s question,’ reads the opinion from Justice Samuel Alito, which Justice Kennedy and Chief Justice John Roberts backed. Justices Thomas and Scalia had a concurring opinion while the remaining four Supremes dissented. [emphasis added]
(Notice Justice Alito referred to our Fifth Amendment right as a “privilege” — Isn’t it wonderful that these people are appointed to their positions for life?)

Of Whistleblowers and Free Inhabitants

Lately, we are hearing a whole lot about whistleblowers, especially NSA whistleblowers and Edward Snowden. Those who see something, say something but just not quite the way Department of Homeland Security Secretary Janet Napolitano had imagined it. Despite supposed federal whistleblower protections, President Obama has the dubious distinction of persecuting more whistleblowers than all other presidents combined. Okay, you get that, but what is a free inhabitant?

Free inhabitants are a portion of Americans that the efforts of whistleblowers are unwittingly helping to liberate. How so? Someone blows the whistle to expose crimes, corruption and conspiracies in the high places of government and commerce, now pretty much one and the same thing. Their revelations open up the public dialogue where previously none existed. Best-case scenario, that dialogue leads to ever-deeper inquiry and new levels of truthful information previously kept from the unwashed masses.

Edward Snowden Charged Under the Espionage Act

On June 21, Obama's Justice Department charged Snowden with espionage. It did so ruthlessly, irresponsibly and unconstitutionally. It wrongfully accused him of violating 1917 Espionage Act provisions.

It was enacted during WWI. It's long ago outdated. It has no current relevance. It belongs in history's dustbin.

It was about interfering with military operations, supporting enemies, promoting insubordination in the ranks, or challenging military recruitment.

At stake are fundamental First Amendment rights. Without them all others are at risk. In Texas v. Johnson, Supreme Court Justice William Brennan wrote the majority opinion, saying:

(I)f there is a bedrock principle underlying the First Amendment, it is that government may not prohibit the expression of an idea simply because society finds the idea offensive or disagreeable.
Justice Hugo Black once said: "Only a free and unrestrained press can effectively expose deception in government." America fails the test.

Everyone knows that when building a police state, it’s vital to strike a few Constitutional rights off the books. Now, we can add the right to remain silent to the graveyard of the American justice system.  

How can you expect the people to be properly subjugated with all those pesky freedoms that the Bill of Rights blathers on about?

The would-be totalitarians can chalk up another victory, because the Supreme Court has made the decision that if you opt to remain silent, that silence can (and will) be used against you in a court of law.

The History of Gun Control

In 1929, the Soviet Union established gun control. From 1929 to 1953, about 20 million dissidents, unable to defend themselves, were rounded up and exterminated.

In 1911, Turkey established gun control. From 1915 to 1917, 1.5 million Armenians, unable to defend themselves, were rounded up and exterminated.

Germany established gun control in 1938 and from 1939 to 1945, a total of 13 million Jews and others who were unable to defend themselves were rounded up and exterminated.

China established gun control in 1935. From 1948 to 1952, 20 million political dissidents, unable to defend themselves, were rounded up and exterminated.

Guatemala established gun control in 1964. From 1964 to 1981, 100,000 Mayan Indians, unable to defend themselves, were rounded up and exterminated.

Uganda established gun control in 1970. From 1971 to 1979, 300,000 Christians, unable to defend themselves, were rounded up and exterminated.

Cambodia established gun control in 1956. From 1975 to 1977, one million educated people, unable to defend themselves, were rounded up and exterminated.

Let’s see how many defenseless people were exterminated in the 20th Century because of gun control:

Governments around the World need a history lesson.

It has now been 12 months since gun owners in Australia were forced by
new law to surrender 640,381 personal firearms to be destroyed by their
own government, a program costing Australian taxpayers more than $500
million dollars. The first year results are now in:
1) Australia-wide, homicides are up 3.2 percent.
2) Australia-wide, assaults are up 8.6 percent.
3) Australia-wide, armed robberies are up 44 percent (yes, 44 percent!)
4) In the state of Victoria alone, homicides with firearms are now up 300 percent.

Note, that while the law-abiding citizens turned them in, the criminals
did not, and criminals still possess their guns! While figures over the
previous 25 years showed a steady decrease in armed robbery with
firearms, this has changed drastically upward in the past 12 months,
since criminals now are guaranteed that their prey is unarmed.

There has also been a dramatic increase in break-ins and assaults of
the ELDERLY. Australian politicians are at a loss to explain how
public safety has decreased, after such monumental effort
and expense was expended in successfully ridding Australian society of guns.

You won’t see this data on the US evening news, or hear politicians
disseminating this information. Guns in the hands of honest citizens
save lives and property and, yes, gun-control laws adversely affect
only the law-abiding citizens.

Take note my fellow Americans, before it’s too late! The next time
someone talks in favor of gun control, please remind them of this
history lesson.
With guns, we are ‘citizens.’ Without them, we are ’subjects.’

Democratic Socialists vs. America First Populists



How many times do you have to hear that going off the financial cliff is a failure of controlling spending as opposed to a lack of revenue? Systemic deficits exist because government is too big, not because taxpayers are not paying their fair share. This assessment is sacrilege to the Democratic Socialists who make up both political parties. The "so called" debate over cutting back the growth in budgetary increases is void of any real substance or focus. The basic reason that the federal government leviathan instills mass hysteria and fear about cutting back on social welfare programs is that the system preaches a false egalitarian and utopia deliverance from reality.

Contrast this dependency viewpoint with the foundations of America First populism. Thomas Jefferson presents the basis for a healthy economy. "Agriculture, manufactures, commerce, and navigation, the four pillars of our prosperity, are the most thriving when left most free to individual enterprise." The National Center for Constitutional Studies summarizes.

Believe in the American Dream!


Here's a blast from the past.

A declaration is an affirmation. Independence means self-government. They could have called The Declaration of Independence, The Affirmation of Self-Government! Aha! The Founders were libertarian.

Abraham Lincoln noted, "Our defense is in the preservation of the spirit which prizes liberty as a heritage of all men, in all lands, everywhere. Destroy this spirit and you have planted the seeds of despotism around your own doors. "

Priebus says that the libertarian philosophy is "almost a non-factor" today. Republocrats AKA the oligarchy seeks to destroy our united spirit for self-government and have openly grown an authoritarian dictatorship in the land of the free. They blow hot air through their megaphones' corporate media.

Just because a dream has not been fully realized is no reason to abandon it. I want to declare, like Mark Twain, that reports of the libertarian philosophy's recent demise have been greatly over exaggerated! Perhaps you thought Uncle Sam was a benevolent spirit, well true patriots tell it like it is! He began ravishing Lady Liberty early on and continues to get away with it!! Uncle Sam, that money hungry beast, has fought against the Dream from square one.

Update: Former Marine Was Picked Up By The FBI Over Facebook Posts About 9/11

A former U.S. Marine who accused the government of lying about 9/11 and spoke of "The Revolution" on Facebook was detained on Friday night, reports Renee Nal of Gather.

According to Brandon Raub's mother, authorities from the FBI, Secret Service and Chesterfield County PD came to their door, questioned Raub about his Facebook posts – which are critical of the official story regarding 9/11 and refer to "starting a revolution" – then handcuffed him and placed him in a Chesterfield PD squad car before taking him directly to John Randolph Psychiatric Hospital in Hopewell, Va.
Raub's mother said he returned about a year ago after serving in Afghanistan (after serving in Iraq) and did not suffer from PTSD.
The Chesterfield PD told us that the situation "was an FBI matter and we were just there to assist them" so it could not provide us with an official reason why Raub was detained.
Raub's mother said that an FBI agent told her Raub was "arrested by the Chesterfield police department" because he "assaulted an officer and resisted arrest," then asked her if Raub "was having any issues relating to people" and told her that "the threats he was making were terrorist in nature."
When asked the Chesterfield PD said Raub has not been charged with resisting arrest and assaulting an officer.
The FBI and Secret Service will not be available for comment until Monday morning.

UN fails to agree on Arms Trade Treaty, opts for possible vote by the end of the year

Thankfully, it appears that the controversial United Nations Arms Trade Treaty (ATT) has been stopped in its tracks, at least for now.

Negotiations have been held between 170 countries from July 2 to July 27, 2012 and yet they were not even able to make a decision on a draft version of the treaty which some say could have threatened the Second Amendment.

However, the treaty, which needed to be adopted by consensus (meaning it would only take one country to veto the deal), has not been shot down completely.

There is still the possibility of further discussions and a draft arms trade treaty very well could be brought before the 193-nation UN General Assembly.

Indeed, some diplomats are clearly confident that this treaty will be put in place, essentially saying it is just a matter of time until it happens.

“We feel that we could have agreed (a treaty). It is disappointing that more time is needed. But an arms-trade treaty is coming – not today – but soon. We’ve taken a big step forward,” said a spokesperson for the British delegation.

Our thoughts and prayers go out to the victims and survivors of the Aurora, Colorado shooting as well as to their families and the brave first-responders.

Such a senseless tragedy leaves us all saddened and speechless for a brief moment . . . but then inevitably we find ourselves being drawn into the national debate over gun control. The timing of the shootings combined with the rabid media attention has seemingly diverted national attention from President Obama and Attorney General Eric Holder’s Fast and Furious debacle, as well as the upcoming United Nations Gun Treaty vote in two weeks -- both of which are blatant attempts to restrict our God-given rights to bear arms.

Thomas Jefferson, himself a liberal in the truest sense of the definition, stated,"The strongest reason for people to retain the right to keep and bear arms is, as a last resort, to protect themselves against tyranny in government."

Now contrast that to what New York Mayor Michael Bloomberg, who has made a career calling for stricter national gun laws, stated . . .

“We are gathered here today to mourn the loss of a dear friend, the Fourth Amendment. Born on the freedom-loving soil of early America, the Fourth Amendment will be remembered as the bulwark of the liberty we once called privacy. For ye, we mourn.”

As you can see, we’re working on a eulogy for the Fourth Amendment, the part of the Constitution guarding against “unreasonable searches and seizures” — in effect, a privacy provision.

When did the Fourth Amendment die, you ask?

Recently, but it’s been sick for a while.
