One Charge Dropped Against Minnesota Mom Who Gave Son Cannabis Oil

A judge has dismissed one of two charges against a Minnesota woman who gave her son cannabis oil for chronic pain. Judge Thomas Van Hon tossed out a charge of child endangerment against Angela Brown of Madison.

New Hampshire Becomes 19th State to Legalize Medical Marijuana

All of New England is now medical marijuana territory, as New Hampshire Gov. Maggie Hassan (D) Tuesday afternoon signed into law a bill allowing it in the Granite State.

"Allowing doctors to provide relief to patients through the use of appropriately regulated and dispensed medical marijuana is the compassionate and right policy for the state of New Hampshire, and this legislation ensures that we approach this policy in the right way with measures to prevent abuse," Hassan said in a signing statement.

"By providing strong regulatory oversight and clear dispensing guidelines, this bill addresses many of the concerns that were expressed throughout the legislative process," she continued. "House Bill 573 legalizes the use of medical marijuana in a way that makes sense for the State of New Hampshire and gives health providers another option to help New Hampshire's seriously ill patients."

Google to Allow Medical Marijuana Advertisements

Google currently does not permit ads to be linked to the words "marijuana" or "cannabis", but that may change eventually.

The most dominant Internet company recently gave a $120,000 donation of services to the medical marijuana advocacy group Michigan Compassion.

The services are in the form of advertising through Google's Adwords program to be used to promote medical cannabis. 

The ads will still not be linked to "cannabis" or "marijuana" search terms. Instead they'll be triggered by terms like "chemotherapy nausea".

The IRS War on Medical Marijuana Providers

Dispensaries providing marijuana to doctor-approved patients operate in a number of states, but they are under assault by the federal government. SWAT-style raids by the DEA and finger-wagging press conferences by grim-faced federal prosecutors may garner greater attention, but the assault on medical marijuana providers extends to other branches of the government as well, and moves by the Internal Revenue Service (IRS) to eliminate dispensaries' ability to take standard business deduction are another very painful arrow in the federal quiver.

The IRS employs Section 280E, a 1982 addition to the tax code that was a response to a drug dealer's successful effort to claim his yacht, weapons purchases, and even illicit bribes as business expenses. Under 280E, individuals involved in the illicit sale of controlled substances -- including marijuana, even medical marijuana in states where it is legal -- cannot claim standard business expenses on their federal taxes.

Rise of the Phoenix: Arkansas Medical Marijuana Act defeated by Small Margin

As the Phoenix is reborn with healing tears, so shall the The Yes on 5 campaign for the Medical Marijuana Act of Arkansas (Ballot Issue 5) which was narrowly defeated on Election Day, November 6, 2012 (52%/48%).

Arkansans for Compassionate Care immediately reported to social media sites a declaration of sorts, vowing to increase Statewide efforts for education and outreach, beginning with the state legislature.
Melissa Fults, treasurer for Arkansans for Compassionate Care, said her group will first pursue the issue through the state Legislature. If that fails, she said, it will again go through a petition campaign to get it on the ballot in two years.

"Needless to say, we're disappointed," Fults said by phone Wednesday morning. "But we were so close. We did more than anybody ever believed we'd do. And we'll start right back."

Fults said she believes the closeness of the race could spur legislators to take up the issue even though previous attempts haven't worked.  (Source)

A proposal to make AR the first southern state to legalize MMJ was rejected by 52% of voters. Chris Kell, the campaign strategist for Arkansans for Compassionate Care, tells The Fix that the narrow loss was due to the "onslaught of propaganda and misinformation that the opposition put out there"—specifically the Arkansas Family Council. "Their whole campaign claimed this was a back door to full legalization—but that's completely false." Despite the outcome, the fact that the issue made the ballot at all—and lost only narrowly—in the conservative state represents significant progress for the MMJ movement.  (Source)

Compassion balanced with responsibility

 — Imagine for a moment that someone you love is suffering from debilitating pain that has not responded to ordinary medications, treatment or surgical measures for more than six months. Her doctor, seeing that the other treatments are not alleviating her pain, recommends that she try marijuana, as it has been effective alleviating the pain of other patients, without any significant negative side effects.
Would you want that pain relief to be a legal option for your loved one?
Imagine now that another person you love is going through chemotherapy treatments, hoping to kill the cancer cells in her body. The treatment is causing nausea so severe she is unable to eat and her strength is deteriorating rapidly. Her doctor, having seen this condition hundreds of times before, recommends that she use marijuana to diminish the nausea and regain her appetite.
Would you want your loved one to have that legal option?

Informed juror saves marijuana dispensary owner from prison

It was almost jury nullification, but not quite. Jason Andrews is a California Medical Marijuana dispensary owner who provides free cannabis to terminally ill patients, and for the past two years he has been facing state charges on Sales and Trafficking of Marijuana, in a state where medical marijuana is legal. Andrews even has all of the required government licensing, and complies with all of the regulations, his operation is 100% legal.

Earlier this year his case was to be decided in court, and things really weren’t looking good for him. Luckily, there was one juror who was informed about the power of jury nullification, and tried his best to convince the jury to rule in favor of the defense, seeing that the charges against Andrews were not only unjust, but also illegal, even according the state. The other jurors would not comply, but juror 101 stood his ground and refused to allow the rest of the jury to put Andrews away.
