Oregon Votes to Legalize Recreational Marijuana This November

Phillip Smith

The New Approach Oregon marijuana legalization initiative has qualified for the November ballot, the secretary of state's office reported today.

It won't get a measure number until next month.

First word came in an email from New Approach Oregon's Anthony Johnson. When the Chronicle contacted Johnson to confirm the email, he said "I got the call from the secretary of state's office today."

The initiative had needed some 87,000 valid voter signatures to qualify; it handed in about 145,000 a couple of weeks ago.

US Sentencing Commission Votes Unanimously to Reduce Drug Sentences Retroactively

Phillip Smith

The US Sentencing Commission Friday voted unanimously to make previously agreed upon federal drug sentencing reductions retroactive. That means tens of thousands of federal drug prisoners could see sentence cuts beginning in November 2015.

The move comes after the Commission's April decision to amend federal sentencing guidelines by lowering base offense levels in the guidelines' Drug Quantity Table across all drug types, which should lead to lower sentences for most federal drug offenders. Today's vote means that sentencing judges can extend that reduction to people currently serving drug sentences.

"This amendment received unanimous support from Commissioners because it is a measured approach," said Judge Patti Saris, chair of the Commission. "It reduces prison costs and populations and responds to statutory and guidelines changes since the drug guidelines were initially developed, while safeguarding public safety."

All of New England is now medical marijuana territory, as New Hampshire Gov. Maggie Hassan (D) Tuesday afternoon signed into law a bill allowing it in the Granite State.

"Allowing doctors to provide relief to patients through the use of appropriately regulated and dispensed medical marijuana is the compassionate and right policy for the state of New Hampshire, and this legislation ensures that we approach this policy in the right way with measures to prevent abuse," Hassan said in a signing statement.

"By providing strong regulatory oversight and clear dispensing guidelines, this bill addresses many of the concerns that were expressed throughout the legislative process," she continued. "House Bill 573 legalizes the use of medical marijuana in a way that makes sense for the State of New Hampshire and gives health providers another option to help New Hampshire's seriously ill patients."

Vermont Decriminalizes Marijuana Starting Monday

Phillip Smith

As of Monday, Vermont will be the 17th state to decriminalize marijuana possession. A bill passed earlier this year goes into effect then.

The measure, House Bill 200, was sponsored by Rep. Christopher Pearson (P-Burlington), with a tripartisan group of 38 cosponsors. It ends criminal penalties for the possession of up to an ounce of marijuana or five grams of hashish and replaces them with fines of $200 for a first offense, $300 for a second offense, and $500 for subsequent offenses. Possession of more than an ounce remains a criminal offense, as does cultivation of any number of plants.

People under 21 caught with decriminalized amounts of marijuana or hash will have to undergo substance abuse screening.
