Bipartisan Coalition Urges Sensible Drug Policy

Introducing Three Bills to Protect Access to Medical Marijuana

Washington -- In a sign of growing bipartisan Congressional support for reforming our nation’s drug laws, a coalition of Republicans and Democrats today offered three bills that would ensure fair treatment of cannabis businesses under tax and banking law, and change existing law to reflect the medical efficacy of marijuana. The bills were authored by Congressman Pete Stark (D-CA), Congressman Barney Frank (D-MA), and Congressman Jared Polis (D-CO).

Stark’s bill – the Small Business Tax Equity Act – would allow medical marijuana dispensaries to take the full range of business expense deductions on their federal tax returns, just like every other legal business is permitted to do under the law. It is co-sponsored by Congressman Dana Rohrabacher (R-CA) and Congressman Ron Paul (R-TX), as well as Frank and Polis.

Funny how when it’s immigration, Arizona Governor Jan Brewer claims states rights and opposes federal interference, but when it’s the state voting for medical marijuana, she invites federal interference.

(East Valley Tribune) Saying she fears people could wind up in legal trouble, Gov. Jan Brewer on Tuesday ordered the state attorney general to get a federal court to rule whether Arizona can implement its medical marijuana law. 

[S]he said a letter from Dennis Burke, the U.S. Attorney for Arizona, to her state health chief appeared to be a warning that anyone involved — from patients and dispensary operators to landlords and even state health officials — could wind up being prosecuted by his office.

The Obama administration’s position on medical marijuana, circa 2009 (via the Ogden memo to all United States attorneys):

“The prosecution of significant traffickers of illegal drugs, including marijuana, and the disruption of illegal drug manufacturing and trafficking networks continues to be a core priority in the Department’s efforts against narcotics and dangerous drugs, and the Department’s investigative and prosecutorial resources should be directed towards these objectives. As a general matter, pursuit of these priorities should not focus federal resources in your States on individuals whose actions are in clear and unambiguous compliance with existing state laws providing for the medical use of marijuana.”

Medical Marijuana Rules Finalized In Arizona, Washington, DC

Regulations have been finalized to allow for the sanctioned-use and dispensing of medical cannabis in two more regions of the country: Arizona and in the nation’s capitol, Washington, DC.

In Arizona, representatives from the Arizona Department of Health Services have approved rules governing the state’s soon-to-be-implemented Arizona Medical Marijuana Program. Voters directed the state to approve regulations regarding the use and distribution of medicinal marijuana in November when they decided in favor of Proposition 203— making Arizona the fifteenth state since 1996 to legalize the physician-authorized use of cannabis. Program rules, physician certification forms, and answers to frequently asked questions are all available online from the Arizona Department of Health Services here.

Vermont Considers Medical Marijuana Dispensaries

MONTPELIER — Here’s what Shayne Lynn envisions somewhere in Chittenden County: an office as non-descript as a doctor’s office or a pharmacy from which he would sell marijuana to those with qualifying medical conditions.

There’d be a waiting room. Clients would be seen by appointment only. There’d be security. He might also offer clients yoga, acupuncture and Reiki. He’d probably grow the marijuana somewhere else, at an indoor facility.

Lynn could become one of the first people to run such an operation in Vermont if proposed legislation the Senate is expected to consider this week passes.

Lynn, a 40-year-old professional photographer who lives in Burlington, said he believes in marijuana’s medicinal value for those who suffer from chronic pain and he thinks it’s wrong that such people have nowhere legal to buy the relief.

Medical Marijuana, Gateway to Big Brother?

Marijuana has traditionally been referred to as the “gateway drug,” reputed to introduce one to harder more dangerous substances. If Colorado lawmakers have their way, a new system of policing to oversee Medical Marijuana sales frequency, quantity, buyer activity, and final point of use, will be introduced soon. Pot may once again become known as the gateway drug, however this time it will be to introduce Big Brother style tracking technology to the general market place.

The Colorado State legislature is looking at passing laws to keep track of medical marijuana purchases from seed to point of usage. These are designed to stop purchases of large quantities from various locations in short time periods, that could then be sold on the black market. State officials say that these laws and the surveillance system they will create, are necessary as protections against medical marijuana system abuses by unlawful drug dealers.

Patients and marijuana advocates see this as an unwarranted intrusion, an invasion of individual medical practices by the state using Orwellian methods. Drivers license swipes and video cameras, to track buyers. State officials are considering fingerprinting patients to eventually implement thumb scanning technology. Also, product tracking by use of passive micro Radio Frequency Identification devices (RFID), in or on all marijuana products will track every gram sold.
