Congress failed 3 times to pass laws (HR 2421, S. 1879 and S. 787) for federal control over almost all water, so the EPA and Army Corps of Engineers are declaring jurisdiction under the Clean Water Act.

Currently, waters with a 'significant nexus' to 'navigable waters' are covered under the Clean Water Act (CWA). The EPA is now trying to assert that the CWA "protects" (controls) traditional navigable waters, interstate waters, adjacent wetlands, tributaries, and 'other waters' which account for just about all water except swimming pools (see page 5).

In this video from 2009, Lisa Jackson admits that she doesn't know what the EPA jurisdiction is for navigable waters or wetlands, and then she says that she does need legislation to clarify the matter! That legislation has already failed 3 times because it is an affront to individualism and property rights. Additionally, several Supreme Court rulings limit EPA power.

Cancún climate change summit: Japan refuses to extend Kyoto protocol

Talks threatened with breakdown after forthright Japanese refusal to extend Kyoto emissions commitments

The delicately balanced global climate talks in Cancún suffered a serious setback last night when Japan categorically stated its opposition to extending the Kyoto protocol – the binding international treaty that commits most of the world's richest countries to making emission cuts.

The Kyoto protocol was adopted in Japan in 1997 by major emitting countries, who committed themselves to cut emissions by an average 5% on 1990 figures by 2012.

However the US congress refused to ratify it and remains outside the protocol.


The brief statement, made by Jun Arima, an official in the government's economics trade and industry department, in an open session, was the strongest yet made against the protocol by one of the largest emitters of greenhouse gases.

He said: "Japan will not inscribe its target under the Kyoto protocol on any conditions or under any circumstances."

The move came out of the blue for other delegations at the conference.

"For Japan to come out with a statement like that at the beginning of the talks is significant," said one British official. "The forthrightness of the statement took people by surprise."

If it proves to be a new, formal position rather than a negotiating tactic, it could provoke a walk-out by some developing countries and threaten a breakdown in the talks. Last night diplomats were urgently trying to clarify the position.

NY City Officials: Tap Water Shows Elevated Lead Levels (Warning Issued for Entire Water Supply)

NEW YORK (CBS 2/1010 WINS) — Whether you live in a house or an apartment, this could impact your life.

There’s a water warning in New York City.

The Department of Environmental Protection said Thursday wait before you drink what’s coming out of your faucet, reports CBS 2’s Pablo Guzman.

Like most people, when Natalia Cole of Maspeth, Queens heard there were elevated levels of lead in the city’s water supply, she got a bit nervous.


“There’s nothing I can do,” she said.

But the city said what was found was an increase in lead so small, it won’t hurt you.

“The levels that were detected, which were very slightly above the action level that the EPA defines, don’t pose any clear public health risk,” said NYC DEP Commissioner Cas Holloway.

Here are a few recent data points for you: (1) The New York Times reports that "skepticism and outright denial of global warming are among the articles of faith of the Tea Party movement." (2) In the National Journal, Ron Brownstein notes that "The GOP is stampeding toward an absolutist rejection of climate science that appears unmatched among major political parties around the globe, even conservative ones....Of the 20 serious GOP Senate challengers who have taken a position, 19 have declared that the science of climate change is inconclusive or flat-out incorrect." (3) It's not just Senate candidates. ThinkProgress notes that an analysis by Wonk Room "finds that 22 of the 37 Republican candidates for governor this November are deniers of the scientific consensus on global warming pollution." (4) TheWall Street Journal reports that "extreme drought" has taken hold in parts of nine states stretching from the Southeast to the lower Midwest.
