With few options left for people to protect themselves from the ever growing police state, an old and long forgotten aspect of constitutional law is making a huge comeback, and becoming very popular in cases where people are facing jail time for nonviolent offenses. 

This reemerging defense is the act of jury nullification, which is basically the right for any juror to not only judge the facts of the case, but to also actually judge the validity of the law itself. This means that if a jury feels that a defendant is facing an unjust charge they actually have the right to rule in their favor even if they are technically guilty. 

Ed Forchion is a medical cannabis user and cancer patient known as the “NJ weedman”. Ed claims dual residency in Pemberton Township, New Jersey and Los Angeles, California. Due to his residency in California he has a prescription for Cannabis and is legally allowed to grow and consume the plant in that state.

A major victory is scored for jury nullification with the acquittal of felony marijuana charges – and it’s all thanks to a “straight-laced little old lady” juror and participant of the Free State Project

PRWEB - Doug Darrell beat the odds and walked home from his trial as a free man on Friday, a major win for the state’s new jury nullification law. Facing felony drug cultivation charges for growing marijuana plants behind his house, the 59-year-old Rastafarian saw all of the charges against him dropped after jurors in his trial successfully convinced their peers to nullify the case on the grounds that Darrell was simply trying to obey the customs of his religion.

“Many of us wondered what kind of precedent this would set,” said juror and FSP participantCathleen Converse in an exclusive interview with Free Talk Live. “But after chewing on all of the possibilities and re-reading the definition of nullification, we all decided that the only fair thing to do was to vote with our consciences and acquit the defendant of all charges.”

I had a jury trial this morning on level 3 possession with intent MJ, level 4 possession drug paraphernalia and level 10 no drug tax stamp. During voir dire, my almost all white, middle-class, middle-aged jury went into full rebellion against the prosecutor stating that they wouldn't convict even if the client's guilt was proven beyond a reasonable doubt -- almost all of them! They felt marijuana should be legalized, what he does with it is his own business and that the jails are already full of people for this silly charge. Then, when the potential jurors found out that the State wanted him to pay taxes on illegal drugs, they went nuts. One woman from the back said how stupid this was and why are we even here wasting our time. A "suit" from the front said this was the most ridiculous thing he'd ever heard. The prosecutor ended up dismissing the case. Judge gave me a dismissal with prejudice. I'm still laughing my ass off over this one. I have NEVER seen a full on mutiny by an entire jury pool before. Easiest win ever!
