Whistleblower: Coast Guard Implementing Martial Law

Earlier this month, the United States Coast Guard upheld its self-declared status as a ‘special’ branch of the military with the ability to prosecute civilians in military tribunals. This startling declaration, unreported in the media, came in a Decision on Appeal related to the case of Lieutenant Eric Shine, a commissioned Naval officer in the Merchant Marines and a graduate of Kings Point Military Service Academy, and was penned by the Vice Commandant of the Coast Guard. Crossing the Rubicon?
The Coast Guard began proceedings to strip Lieutenant Shine of his merchant mariner license in March, 2003, supposedly as the result of incidents related to his service on two private vessels in 2001. In actuality, as Lieutenant Shine points out, the charges were brought in retaliation for attempting to blow the whistle on illegal dumping and other practices he had been asked to engage in during his employment. The Coast Guard’s case against him rested on two hostile witnesses (who had previously been named by Shine in his whistleblower litigation) and the Chief of the Coast Guard Medical Evaluations Office, an officer in the Coast Guard who had never examined Shine but was willing to testify to his medical incompetence.

The precedent-setting nature of Lieutenant Shine’s case—with the Coast Guard prosecuting him as an alleged civilian in an Article 32 military tribunal—is disturbing enough. But when this case is set in the history and context of the Coast Guard and its repeated attempts at “crossing the Rubicon,” an even more disturbing picture emerges.
In 49 B.C., Julius Caesar led the Roman Legion across the Rubicon and into Rome itself, defying the Roman Senate and soon thereafter declaring himself Emperor for life. This was the beginning of the changeover from the Roman Republic to the Roman Empire and the phrase “Crossing the Rubicon” is now used to refer to a move by government toward military dictatorship and the suspension of civil liberties.
Unbeknownst to most Americans, the United States Coast Guard has been attempting to ‘cross the Rubicon’ for decades, and actually achieved that goal in a silent coup in 2003 when it was moved from the Department of Transportation into the newly-created Department of Homeland Security. This change was not merely bureaucratic; it allows the Coast Guard to now openly declare itself “one of the five armed forces of the United States and the only military organization within the Department of Homeland Security.” The problem is that the Coast Guard is now attempting to straddle the line between a civil service agency (as it was set up to be and indeed has always been, except during times when it was specifically placed in the service of the Navy) and a branch of the military, conforming to the Uniform Code of Military Justice.
For those who understand how the United States military has been set up, and the laws and prohibitions against military personnel engaging in the policing of civilians, the fact that the Coast Guard wants to act as a maritime police agency at the same time as it declares itself a branch of the military is a clear indication that the United States is now officially under martial law.
In 1878, Congress passed a law known as Posse Comitatus that prohibited the use of military personnel or assets in domestic law enforcement. At the time, it was clear that the act was an attempt to prohibit the military from policing civilians on U.S. soil, as happened in the South under Reconstruction. What has been taking place in earnest since 9/11, however, is an attempt to erode the spirit and the substance of Posse Comitatus so that the Executive branch can effectively ‘cross the rubicon’ and use military personnel in domestic policing operations.
As the video below demonstrates, both Democratic and Republican demonstrations have been attempting to overcome Posse Comitatus for decades, and 9/11 was the blank cheque they needed to kick their agenda into high gear:
On October 23, 2001, unconvicted war criminals John Yoo and Robert J. Delahunty wrote to White House counsel Alberto Gonzales giving the legal opinion that “The president has ample constitutional and statutory authority to deploy the military against international or foreign terrorists operating within the United States.” The Bush Administration then tried to use that very opinion to justify sending American troops into the suburbs of Buffalo to seize a group of men who were claimed to be working with Al Qaeda. The decision was evidently made not to pursue that course of action at that time, but the legal opinion stood and the Administration waited for the opportunity to formalize the legality of deploying troops on home soil.
That opportunity came in 2006, after years of scaremongering over the “War on Terror” (which former Homeland Security chief Tom Ridge later admitted was done to influence voters at politically sensitive times). A section (1076) was slipped into the John Warner Defense Authorization Act that granted the president the authority to deploy troops domestically during “national emergencies.” In 2008, Congress attempted to take these powers away from the administration by passing legislation repealing the offending sections of the Act, but President Bush issued a signing statement when signing that legislation into law saying that his administration was not bound by it.
From that point on, the legal floodgates have been open and a stream of increasingly disturbing reports have confirmed that Posse Comitatus had been repealed and that the public is being conditioned to accept uniformed military personnel policing American civilians on the streets of America.
In September 2008, the Army Times reported that the 3rd Infantry Division’s Brigade Combat Team had been reassigned to NORTHCOM to patrol the “homeland” in crowd control and civil unrest situations.
In December of 2008, the Marine Corps Air and Ground Combat Support Group dispatched uniformed troops to aid police checkpoints in California.
In September of 2009, the Army and Air Force provided assistance to the National Guard for security at the G20 in Pittsburgh.
Also in September of 2009, the Assistant Secretary of Defense in Obama’s Defense Department requested authorization to deploy 379,000 troops inside the U.S.
But this issue is not merely an American one. There is currently a coordinated agenda across the Western world to harmonize these types of rubicon-crossing moves toward outright martial law across borders.
In March 2009, the Canadian military—which began a formal merger with the American military in February 2008 that would see American troops deployed on the streets of Canada and Canadian troops in America during ‘national emergency’—announced that it, too was preparing special reserve units to provide for ‘domestic security’ during times of civil unrest. The troops are being trained in various crowd control and emergency measures, such as how to set up and maintain internment camps for Canadian citizens in the event of such things as enforced quarantines after a bioterror attack.
Also in March 2009 it was revealed that the British Army was being readied to deal with Brits should rioting break out in the UK.
What all of this case history reveals is that there is a coordinated agenda to knock down any remaining walls separating the general population of America, Canada and the UK from their own militaries. Nowhere is this more apparent than in the way the Coast Guard has quietly shifted from a federal policing agency into a self-declared branch of the military.
As Lieutenant Eric Shine rightfully asks in his own article on the subject, how does the Revenue Cutter Service, originally located in the Department of the Treasury, merge with the Lighthouse Service, the Ice-breaking Service and other civil service agencies to become a branch of military? How does a branch of the military end up in the Department of Homeland Security, whose mission is explicitly to police the “homeland” and its residents? How does this branch of the military get away with filing charges in a military tribunal against an alleged civilian who has never served in their uniform, and then proceed to prosecute, adjudicate and act as appellate of that tribunal?
And perhaps the most important question of all: When will the American public, and the peoples of the other Western powers, realize that the Rubicon has long since been crossed and that they are already living in a military dictatorship?

U.S. troops now being trained to boss communities and run local governments are being readied to oversee a post-collapse America in which riots and civil unrest similar to that now exploding in Europe over austerity measures and pension cuts ravage the United States and are met with the iron fist of a militarized police state.
Reaction to our earlier story about the 3rd Brigade Combat Team, 10th Mountain Division being prepared for a situation where “in essence they will become the local government” by working with local officials has been strong, with some refusing to believe that the program is geared towards anything other than operations overseas.
However, as we outlined in our article, similar deployments by Northcom are admittedly focused around “homeland patrols” and training troops to deal with “civil unrest” and “crowd control”.
We have documented numerous incidents over the past several years where active duty troops or national guard have been used in domestic law enforcement operations.
The military are now being called upon to undertake roles normally designated to police as Americans are incrementally acclimated to accept the presence of troops on the streets as an everyday occurrence, in preparation for them to be used should the United States enter a post-collapse period of turmoil and unrest.
We covered a case in Kingman Arizona last September, where National Guardsmen were filmed “providing security” and directing traffic.
Another example occurred in Newport Kentucky, when military checkpoints suddenly appeared downtown on September 6 last year. Military Police from the U.S. Army National as well as Marines were purportedly conducting “traffic control” because the city was strapped for funds and did not have enough police to do the job.
The excuse that troops are stepping in to help because there is a lack of police doesn’t wash.Crime is down over the last 20 years, there are around three times more police and the state is not calling out the National Guard, they are being put on the streets as a result of the harmonization of police and military, a process that has been ongoing for decades, long before the economic recession hit. Troops also have guns and their primary function is to search people and vehicles, not direct traffic.
Members of the WeAreChange Ohio group interviewed some of the troops, who when asked if they would be prepared to “confiscate guns, shoot resisters in the back of the head, or throw people into ovens to incinerate bodies,” refused to categorically deny that they would follow such orders.
However, this was by no means the first time that troops have been used to fulfill roles normally ascribed to police in Kentucky.
During the Kentucky Derby on May 2 last year, Military Police were on patrol to deal with crowd control. An Associated Press photograph shows armed MP’s detaining a man who ran onto the track following the 135th Kentucky Derby horse race at Churchill Downs.
“The military has NO BUSINESS policing the citizens except during extraordinarily exceptional times of national emergency by an executive order. This is very disturbing and completely un-American. Maybe even more disturbing is that no one seems to care how quietly and easily we have accepted the burgeoning police state,” one respondent to the photo stated.
As we reported in 2008, U.S. troops returning from Iraq are now occupying America, running checkpoints and training to deal with “civil unrest and crowd control” under the auspices of a Northcom program that by 2011 will have no less than 20,000 active duty troops deployed inside America to “help” state and local officials during times of emergency.

Over the course of the last few of years, we have reported on numerous instances of military involvement with local law enforcement in violation of Posse Comitatus.
In January 2009, soldiers from the Virginia National Guard. Soldiers from the Lynchburg-based 1st Battalion, 116th Brigade Combat Team, were used to conduct personal searches at checkpoints in Washington DC for the inauguration of Barack Obama.
In February, no less than 2,200 U.S. Marines were also involved in urban operations training in Richmond, VIrginia, throughout January, drills that involved landing troops in populated areas, allowing military pilots to “familiarize themselves with the area.”
On April 6, we reported on a DHS, federal, state, Air Force, and local law enforcement checkpoint in Tennessee. On April 3, Infowars was instrumental in the cancellation of a seatbelt checkpoint that was to be conducted in conjunction with the Department of Homeland Security and the 251st Military Police in Bolivar, Tennessee.
In December 2008, we reported on the Marine Corps Air and Ground Combat Center dispatching troops to work with police on checkpoints in in San Bernardino County, California.
On April 22, we reported the deployment of 400 National Guard Combat Support Battalion troops to “maintain public order” at the Boston Marathon.
In June, Infowars posted an article byD. H. Williams of the Daily Newscaster reporting the deployment of 2,300 Marines in the city of Indianapolis under the direction of FBI and the Department of Homeland Security.
We also reported a story on April 22 covering the assault of a local television news team by an irate police officer in El Paso, Texas. A video taken by the news videographer shows uniformed soldiers working with police officers at the scene of a car accident.
The presence of uniformed and armed military police is part of an ongoing campaign to acclimate the populace to the presence of soldiers at public events.
Northcom was only relatively recently assigned its own fighting unit – the Army’s 3rd Infantry Division’s 1st Brigade Combat Team, which had been fighting in Iraq for five years before that.As we have previously reported, the Armed Forces Press Service initiated a propaganda campaign designed to convince the American people that deploying the 3rd Infantry Division in the United States in violation of the Posse Comitatus Act is a good thing, with images of soldiers from the brigade helping in “humanitarian” rescue missions, such as car wrecks. This is all designed to condition Americans to accept troops on the streets and highways as a part of everyday life.
The assignment of the 1st Brigade Combat Team to Northcom alarmed the American Civil Liberties Union (ACLU). “This is a radical departure from separation of civilian law enforcement and military authority and could, quite possibly, represent a violation of law,” said Mike German, ACLU national security policy counsel.
The last time the the national guard and military worked with FEMA and local law enforcement on a large scale in the United States was during Hurricane Katrina, when they aided in the confiscation of privately owned firearms of citizens, even those who lived in the high and dry areas and were unaffected by the hurricane.
In August last year it was reported that the Pentagon was attempting to “grant the Secretary of Defense the authority to post almost 400,000 military personnel throughout the United States in times of emergency or a major disaster,” wrote Matthew Rothschild for The Progressive.
“In June, the U.S. Northern Command distributed a “Congressional Fact Sheet” entitled “Legislative Proposal for Activation of Federal Reserve Forces for Disasters.” That proposal would amend current law, thereby “authorizing the Secretary of Defense to order any unit or member of the Army Reserve, Air Force Reserve, Navy Reserve, and the Marine Corps Reserve, to active duty for a major disaster or emergency.”
Collating all the evidence of how the military has been seamlessly ingrained into the daily lives of Americans by way of uniformed troops undertaking law enforcement duties, there can be no doubt that the U.S. is already under a condition of undeclared martial law.
This has nothing to do with Afghanistan or Iraq – this is about turning America into a militarized police state in anticipation of widespread rioting.
Only by becoming aware of how far America has sunk into a militarized police state can we begin to reverse the incremental conditioning that has led Americans to accept the sight of troops on the streets demanding their papers.
It is important to understand that we are witnessing a deliberate collapse of society where the shrinking middle class is left with no other option but to riot in a last ditch effort to salvage their rapidly evaporating wealth.
We are already seeing tensions build in France and other areas of Europe as part of the growing backlash against austerity measures and government seizure of pensions. Now the government is preparing to openly loot all private 401(k) pension funds, which could be the straw that breaks the camel’s back and turns once passive Americans into angry mobs.
Numerous forecasters, governments, spy agencies, and international bodies are predicting mass riots and unrest in response to a worsening economic picture.
In November 2008, right as the economic implosion was unraveling, the U.S. Army War College released a white paper called Known Unknowns: Unconventional ‘Strategic Shocks’ in Defense Strategy Development. The report warned that the military must be prepared for a “violent, strategic dislocation inside the United States,” which could be provoked by “unforeseen economic collapse,” “purposeful domestic resistance,” “pervasive public health emergencies” or “loss of functioning political and legal order.” The “widespread civil violence,” the document said, “would force the defense establishment to reorient priorities in extremis to defend basic domestic order and human security.”
Authorities have also made preparations for deploying troops to round up Americans in the aftermath of an immigration influx should Mexico completely collapse, which is a very real prospect.
During the Iran Contra hearings in the 80′s, previously classified information came to light about Continuity of Government (CoG) procedures in times of national crisis. The masterminds behind these programs were Oliver North, Donald Rumsfeld and Dick Cheney. The Rex-84 ‘readiness exercise’ discussed the plan to round up immigrants and detain them in internment camps in response to uncontrolled population movements across the Mexican border.
The real agenda was to use the cover of rounding up immigrants and illegal aliens as a smokescreen for targeting political dissidents and American citizens. From 1967 to 1971 the FBI kept a list of persons to be rounded up as subversive, dubbed the “ADEX” list.
Since 9/11, shadow government and CoG programs that were outlined in Rex-84 have been activated, including mass warrantless wiretapping of American citizens.
According to respected author Peter Dale Scott, “Both the contract and the budget allocation are in partial fulfillment of an ambitious 10-year Homeland Security strategic plan, code-named ENDGAME, authorized in 2003. According to a 49-page Homeland Security document on the plan, ENDGAME expands “a mission first articulated in the Alien and Sedition Acts of 1798.” Its goal is the capability to “remove all removable aliens,” including “illegal economic migrants, aliens who have committed criminal acts, asylum-seekers (required to be retained by law) or potential terrorists.”
Let us be under no illusion that U.S. troops are being trained to target the American people, and when similar scenes to those currently unfolding in Europe hit U.S. streets, the response is going to be a whole lot more brutal, which is why active duty soldiers who have been occupying Iraqi and Afghan cities for the past several years are now being brought home to deal with Americans whose anger over foreclosures, seized pensions, a collapsing dollar and mass unemployment will ultimately reach boiling point as the descent into depression becomes overwhelming.

Government Trains Troops To Run American Cities

Local government officials are training active duty military soldiers to run communities, re-igniting fears that troops will be used to deal with civil unrest in the event of a total economic collapse or other national emergency in a newly militarized America.
“The 3rd Brigade Combat Team, 10th Mountain Division met with City Manager Mary Corriveau, Mayor Jeff Graham and other City officials gaining insight about city infrastructure,”reports ABC 50.
“Government 101 is a new program that Fort Drum has established to learn from local officials about what it takes to run a community efficiently.”
The 10th Mountain Division is a light infantry division of the United States Army based at Fort Drum, New York that specializes in fighting under harsh terrain and weather conditions. The unit was deployed to Afghanistan in 2006 for one year and then to Iraq in April 2008.
The troops are being prepared for “A sitution where in essence they will become the local government,” said Corriveau.
The program is ostensibly aimed at preparing troops to govern occupied areas of Afghanistan, but as we highlighted over the last two years, the real purpose behind the training could hit a lot closer to home.
A similar program that was announced back in September 2008 involving the 3rd Infantry Division’s 1st Brigade Combat Team was geared around training troops who had recently returned from Afghanistan to conduct “homeland patrols” which began on October 1st of that year.
According to an Army Times report, part of the troops’ mission was to deal with “civil unrest and crowd control” by using non-lethal weapons against the American people. After the announcement caused controversy, the Army Times was forced to issue a clarification, claiming that the non-lethal weapons training was intended for use overseas, but the part about “civil unrest and crowd control,” a complete violation of the Posse Comitatus Act, was not retracted.
In November 2008, Northcom announced that over the course of the following three years, an additional 4,700 troops would be assigned for domestic homeland security missions.
The very next month, the Armed Forces Press Service initiated a propaganda campaign designed to convince the American people that deploying the 3rd Infantry Division in the United States in violation of the Posse Comitatus Act was a good thing,as fully uniformed soldiers were photographed helping to save car wreck victims, in another effort at incrementally conditioning Americans to accept troops on the streets as normal, despite the fact that it is the hallmark of corrupt dictatorships and empires in terminal decline like the former Soviet Union.
Under the pretext of “helping” local communities short of police in difficult economic times, U.S. troops are now occupying America as the country sinks into a state of de facto martial law.
The military are now being called upon to undertake roles normally designated to police as Americans are incrementally acclimated to accept the presence of troops on the streets as an everyday occurrence.

With the government preparing to seize Americans’ private pensions as the economy further deteriorates, innumerable forecasters are predicting riots and mass civil unrest once the vanishing middle class finally rises from its slumber and realizes that their entire way of life is under immediate threat.
Unless we can communicate the fact that having troops patrol the streets is not normal and in reality is a warning siren for a country in dire straights, those same troops will soon be firing non-lethal weapons at angry American citizens – or worse.
As Gerald Celente often warns, once Americans have lost everything, they will begin to lose it – rioting in massive numbers and mirroring the growing civil unrest we are already seeing in Europe as people rise up en masse in a backlash against austerity measures and governments raising the age of retirement and seizing pensions.

Creeping Militarism Invades Alaska Grade School

In 1787, Thomas Jefferson lamented the fact that the newly minted Constitution lacked any specific provisions on standing armies. “I do not like the omission of a Bill of Rights providing clearly and without the aid of sophisms for… protection against standing armies,” Jefferson wrote Madison. “The spirit of this country is totally adverse to a large military force,” he told Chandler Price in 1807.

Now? We relish large armies and enthusiastically send them out to kill people and break things around the world. The government and the corporate media encourage us to “support our troops” as they illegally occupy foreign lands and engage in war crimes. George Washington’s admonition, expressed in his Farewell Address, that the United States extend commercial relations and have with foreign nations as little political connection — to say nothing of military — as possible is almost entirely forgotten.
In violation of Posse Comitatus — a law in the spirit of Thomas Jefferson’s warning about the militarization of civil society — the Pentagon works hand-in-hand with local law enforcement. Increasingly, militarized police are becoming an extension of the Defense Department, the Department of Homeland Security, and even the CIA and the FBI. Few seem to understand the grave danger of this tendency.
Now the military has invaded our grade schools. “A new partnership between the Anchorage School District and the U.S. Army Alaska will add a military presence to local schools,” reports the Alaska Star. “School and military officials said the program will help students academically. But having uniformed military in schools also will lend support to children of military members on deployment, they said, and give non-military kids an understanding of what soldiers do for the country.”
If schools in Alaska want to help students academically, they would bring in scholars and education experts, not soldiers. Ideally, students should be home schooled and completely divorced from the pernicious influence of the military and the federal government.
The effort in Alaska has little to do with test scores and literacy. It’s about inculcating the young to the presence of the military. Contrary to the warnings of Jefferson — who knew standing armies will invariably be employed to enslave the people — the U.S. military has over the span of several decades crept into nearly every public aspect of life.
The military instinct in society is now second nature, so much so that a high school in South Carolina has automatically enrolled students in a Junior Reserve Officers Training Corps with little outrage or opposition. “The entire freshman class at Carvers Bay High School has been automatically enrolled in the Junior Reserve Officers Training Corps, a military-sponsored program that trains high school students in military discipline and concepts,” The Sun News in Myrtle Beach, South Carolina, reported this week.
“The breaking men to military discipline is breaking their spirits to principles of passive obedience,” Jefferson wrote John Jay in 1778.
It is not merely soldiers or would-be-soldiers in training who are expected to be passively obedient. In fact, the whole of society is now expected to react with passive obedience to an out of control military and federal government. A militarized police state — where soldiers and military technology are integrated within society — is sold to us as normal and admirable, especially since the advent of September 11, 2001 when cave-dwelling Muslims supposedly attacked us from afar.
Jefferson’s “supremacy of the civil over the military” is now a thing of the past. The Pentagon has not only invaded our high schools, but may now be found in our grade schools teaching the very young and impressionable.
